If it were me, I'd give the seller a call, tell him that he is in violation of a legal contract, and that you're going to call a lawyer. See what he does then.
eBay says that bids meet reserve or are on non-reserve auctions create binding contracts. Courts don't necessarily like to force specific performance on contracts, instead usually awarding damages. Either way, he owes something...as does the buyer. Who knows what a judge might do?
