Ah, even in the smog-Nazi counties here in Missouri you can get away with anything. My '77 Corvette has none of the factory emissions equipment and a very non-conforming exhaust, and it still passes the "treadmill" test without a problem.
They can give a visual inspection (not supposed to pass without required equipment), but they only do it if you have repeated failures.
